2. Your status: independent contractor
You act as an independent business, not as our employee, worker or agent. You decide when you offer tours, how you run them and at what price, within these rules. You are free to work for other platforms and directly for your own clients.
You sell your tours to travellers yourself; Locals Guide acts as intermediary and commercial agent that collects payments on your behalf. The traveller's payment to Locals Guide discharges the traveller's debt to you. Locals Guide issues receipts to travellers in your name as your agent.
3. Commission
Locals Guide receives a commission of 15% of the booking price (including any VAT you charge) for every paid booking. The rest is your earning. The commission is deducted before payout. We issue a numbered commission invoice for every payout.
If the commission changes, we notify you by email at least 15 days in advance (Art. 3(2) Regulation (EU) 2019/1150). You may terminate before the change takes effect. Bookings made before the change keep the old rate.
4. Payouts
- When a traveller pays, your earning is recorded in your wallet as pending.
- After you mark the tour as finished, the earning is held for 48 hours (hold period) so travellers can report problems. It then becomes available, unless a problem report is open.
- You can request a payout once your available balance is at least 50,00 €. We pay approved requests by bank transfer, normally within 5 business days, to the account in your profile.
- We may set off refunds, chargebacks and amounts wrongly paid against your balance or future earnings.
5. Your duties for tours and cancellations
- Describe tours accurately (format, what the session shows, duration, language, what is included, accessibility) and keep dates up to date.
- For live video tours, add a working join link before each date, join a few minutes early and keep a steady connection. Film only where filming is allowed and respect the privacy of people around you. For calls, call the traveller on the number given at booking at the booked time.
- Minimum group: if a date has not reached its minimum 24 hours before the start, it is cancelled automatically and travellers are refunded; no commission is charged on refunded bookings.
- Cancel only for serious reasons and as early as possible, through the dashboard. Travellers are refunded in full. Repeated cancellations can lead to restrictions under section 9.
- Honour the cancellation terms shown on your tour page; they bind you towards the traveller.
- Mark each tour as finished only after it has taken place.
6. Licences, insurance and the law of the country
You are solely responsible for holding every licence, qualification and registration required to guide in the places where your tours run (for example regional tourist guide licences in Italy, Spain, France, Greece, Portugal, Croatia or Czechia, and permits for protected sites), and for keeping them valid. You warrant this when you publish a tour and upload proof on request. You must hold adequate professional liability insurance for your tours. You follow local rules on group sizes, safety, public spaces and entrance fees.
7. Taxes, VAT and DAC7 reporting
You are responsible for declaring your income and for any VAT on your tours. In your dashboard you enter your tax details (legal name, address, tax identification number, date of birth or company registration number, VAT status). Under Council Directive (EU) 2021/514 (DAC7) we must collect these details, verify them and report your earnings, number of bookings and our fees once a year to the tax authority; you receive a copy of the data reported. If you do not provide the details after two reminders, we must suspend payouts until you do.
8. Data protection
We process your data as described in our Privacy Policy. You receive travellers' names, emails and booking details only to run the tour and are an independent controller for them: use them for nothing else, keep them confidential and delete them when no longer needed (at the latest 12 months after the tour, unless the law requires longer).
9. Ranking, restriction, suspension and termination
Main ranking parameters: upcoming availability, recency, the filters a traveller uses and, where available, ratings. You cannot pay for a better position.
We may restrict or suspend listings or your account for breach of this agreement, illegal content, justified complaints or missing tax details. We inform you of the reasons before or at the moment the restriction takes effect (Art. 4 Regulation (EU) 2019/1150; Art. 17 Regulation (EU) 2022/2065). Termination of the whole account requires 30 days' notice with reasons, except where the law or a serious breach requires immediate action. Either party may end this agreement with 30 days' notice; confirmed bookings are completed or refunded.
10. Complaints and mediation
Send complaints about our decisions or the platform to [email protected]. We consider them and reply within 14 days. If we cannot agree, both parties may try mediation in good faith before going to court.
11. Liability and final provisions
Each party is liable without limitation for intent, gross negligence and injury to life, body or health; otherwise liability is limited to the typical, foreseeable damage. You indemnify Locals Guide against third-party claims arising from your tours or missing licences. This agreement is governed by the law of US. Changes are notified at least 15 days in advance; the version you accepted and the time of acceptance are stored in your account.
